The Texas 3rd Court of Appeals agrees with you, Megs
The judges declared, "The existence of the FLDS belief system as described by the department's witnesses, by itself, does not put children of FLDS parents in physical danger."

Yeah, I just saw this. I'm still really conflicted about where the children should be, but I do think that preemptively taking them away is not a good idea.
Anyone seen Gone Baby, Gone? It's a movie that raises similar themes. Interestingly, when we talked about that movie, solon and I had opposing points of view from our stances on this case. So obviously, I haven't made my mind up yet.
I can just imagine being one of those mothers, though, and how gut-wrenching it would be to have your children taken away because of your beliefs.
This looks like a satisying verdict, at least inasmuch as the Opinion explicitly rejects the argument that abuse is institutionalized in the community.
Neither Harrogate nor anyone else had a right to judge them based on what was being put out there on television alone. And Harrogate apologizes into the internet ether for having done so with no evidence.
Now, he hopes for the best, that the Court got it right, and that the children will be okay.

I think Gone Baby, Gone is an apt comparison here. Bottom line, we may not know the best decision for these children for years to come.
